Terms and Conditions
These terms of use (“Terms of Use”) govern use of the Gameguys website and Gameguys services. By using, visiting or browsing the Gameguys website you agree to be bound by the Terms of Use. If you do not agree with the Terms of Use you must cease using the website immediately and you are not eligible to use any of Movieguys services.
Gameguys membership plans
The Gameguys Standard membership plans are a monthly subscription that allows subscribers to rent as many games as they want, with no late fees. If you subscribe to Gameguys services you agree that Gameguys may charge or debit, as applicable, the payment method selected by you with the monthly subscription fee applicable to the services subscribed for plus any other charges you may incur in connection with your use of the Gameguys website. The subscription fee will be billed (meaning charged or debited as applicable) at the beginning of your subscription which will be at the time where the first dispatch of games to you is due and monthly thereafter in advance on the same monthly date or on the last day of the month (or on the business day before or after such date where such date falls on a day other than a business day on which banks are open in Australia). All fees and charges are non refundable. Gameguys may change the fees and charges in effect, or add new fees and charges from time to time by giving you advance notice of these changes by email. If you wish to use a different payment method accepted by Gameguys or if there is a change in your credit card validity or expiration date, you may edit your payment method information by clicking on the “Account Details” button which is available on the Gameguys website when you're logged in. If you wish to terminate subscription to Gameguys you must terminate before a particular monthly billing date to avoid liability for that monthly payment. No refunds or credits are given for part months. Gameguys will continue to bill your payment method on a monthly basis for the Gameguys services you have selected until you or we terminate your subscription. Your subscription can be terminated by Gameguys by email notice.
Gameguys $19.95 (1 game) membership plan
This Gameguys membership plan is on the same terms as the Gameguys Standard membership plan except that you pay $19.95 including GST per month and can have one Game out at a time. With this plan you can swap the Game as many times as you wish, however excessive swaps for the month will cost an additinal $1 per extra swap. (Refer- Fair Use Policy) All other terms apply.
Gameguys $29.95 (2 game) membership plan
This Gameguys membership plan is on the same terms as the Gameguys Standard membership plan except that you pay $29.95 including GST per month and can have two Games out at a time. With this plan you can swap the Games as many times as you wish, however excessive swaps for the month will cost an additinal $1 per extra swap. (Refer- Fair Use Policy) All other terms apply.
Supply of Games
Gameguys will supply you by post or such other means as are selected by it up to the maximum number of DVDs or games at a time applicable to your plan provided there are no more than the maximum number of games out at a time (which means that Gameguys must have received back from you one or more of the DVDs or games previously supplied to you). Gameguys reserves the right to send any greater or lesser number than the maximum number of games at its discretion. As soon as practicable after receipt of returned games at its address as indicated on the return paid envelope supplied to you, Gameguys will dispatch further games(subject as aforesaid) and so on.
Coming Soon Titles
Release dates for games may sometimes be changed by our suppliers without notice. As such we cannot guarantee the avaliability of some titles. We do however recieve most stock before its release date and can sometimes have the product to you by the time it hits the stores.
Notice of shipment
When games have been shipped they will be added to the 'Current Rentals' page of your account. Please note that actual delivery times may vary for you depending on inventory availability, your delivery address, when you place your order and any circumstances affecting delivery by post.
Return of Games
Paying customers can go to thier current rentals page and click on any titles they have put in the post. Their next available picks in their request list will be shipped the same day, therefore reducing turnaround times.
You agree to return all games sent to you by Gameguys in the return paid package supplied to you. Gameguys will be under no obligation to provide any other means of return of games. If you are unable to use such package for any reason it is your responsibility to return games to Gameguys at your own expense and risk. Games will not be received by Gameguys until they have been received at Gameguys premises and logged as having been received. Gameguys may at any time, by email notice to you, require you to return to it any game or games supplied to you and you agree to return such game or games to Gameguys within 7 days of Gameguys sending such notice.
All Discs are to be returned with one title per envelope. If the game has 2 Discs they are to be sent in the same envelope.
Loss or Damage
You are responsible for any loss or damage caused to any Game supplied to you and you authorize Gameguys to debit your payment method with the cost of replacement of any lost or damaged Game.
Changing from one membership plan to another
If you change to another membership plan the change will take effect on your next billing date at which time you will be billed the rate applicable to the new plan.
Pausing Subscription
If Gameguys pauses or you pause your membership, until all Game or Games are returned to Gameguys, your membership will continue to operate as an active membership. Once all titles out to you have been returned your account will pause until you want to it activate again.
If your monthly subscription is due before all titles have been returned you will be charged for another month. Any outstanding days remaining after all titles are returned, will not start counting down again until you activate your subscription again.
You will still be liable to pay Gameguys the cost of any damaged Games returned to Gameguys and for any non returned Games and you authorize Gameguys to debit your payment method with such costs and you agree that you will not seek to deny Gameguys such recovery.
Cancellation
If Gameguys cancels or you cancel your membership you agree to return to Gameguys any Game or Games sent to you within 7 days of canceling your membership. You will still be liable to pay Gameguys the cost of any damaged Games returned to Gameguys and for any non returned Games and you authorize Gameguys to debit your payment method with such costs and you agree that you will not seek to deny Gameguys such recovery.
Default of Payment
Without prejudice to any other remedies Gameguys may have, if you default in payment of any membership instalment when due, Gameguys may suspend or terminate the supply of games to you. Gameguys will not be liable to you for any loss or damage you suffer because Gameguys has exercised its rights under this clause. In the event monies are owed to Gameguys due to cancellation of membership and/or subsequent charges incurred due to damage to, non-return or loss of games, or any monies owed for any other reason, then you shall be liable for all costs and disbursements incurred by Gameguys in pursuing the debt including legal costs on a solicitor and own client basis and any costs incurred by Gameguys's collection agency in pursuing the debt.
Account Access
In order to provide you with a customised facility, Gameguys will place a cookie (a small text file) on any computer from which you access the Gameguys website. If you select “Remember”, when you revisit the Gameguys website, this cookie will enable Gameguys to recognise you as the account holder and provide you with direct access to your account without requiring you to retype any password or other identification. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree that Gameguys will be entitled to rely on any communication ostensibly from your computer as being from you and may act accordingly.
Representations and Warranties
Gameguys will use its best endeavours to provide a prompt and efficient Internet based Game rental service. Gameguys makes no representations or warranties of any kind with respect to the Gameguys website or its contents and assumes no liability or responsibility for any errors or omissions in the content of the Gameguys website, or for any failures, delays, or interruptions in the shipment of Games, delivery of any content contained on the Gameguys website, any losses or damages arising from the use of the content provided on the Gameguys website, or any conduct by users of the Gameguys website. Gameguys reserves the right to ship Games in its sole discretion. Gameguys disclaims all representations and warranties, including for example warranties of merchantability or fitness for a particular purpose except as required by law. Gameguys makes no warranty that the information accessible via its website is accurate, complete or current.
No Liability
In no event shall Gameguys, its shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, direct or indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any basis of liability, arising out of or in connection with the use or performance of Gameguys services or any goods or services provided by it.
Content is Private Property
All content of the Gameguys website including text, graphics, photographs, images, audio/video clips, data compilations, software, or downloads is the property of Gameguys or its suppliers and is protected by copyright laws. No reproduction of any material on Gameguys website is to be made without the express prior written consent of Gameguys.
Trademark
Gameguys is a trademark of Gameguys.com.au. No use may be made of Gameguys trademark for any purposes without Gameguys prior written consent. All other trademarks appearing on Gameguys website are the trademarks of the relevant owners who may or may not have any connection with Gameguys. No endorsement of Gameguys products or services is implied through use of any person or personality's image or the depiction of any other product or service.
Right to change Terms of Use
Gameguys reserves the right to change these Terms of Use at any time by posting new terms of use on its website. Any change shall take effect 14 days after the change is first posted on the website, unless indicated otherwise in the Terms of Use. You will be deemed to have accepted such new Terms of Use if you use the Gameguys website or Gameguys services after such changes take effect.
Privacy
Any information submitted by you on the Gameguys website is subject to Gameguys privacy policy. Please refer to our privacy policy on our website.
Restrictions on Activities
You agree not to upload, post, email or otherwise send or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Gameguys website. You also agree not to interfere with the servers or networks connected to the Gameguys website or to violate any of the procedures, policies or regulations of networks connected to the Gameguys website, the terms of which are incorporated in these Terms of Use. You agree not to impersonate any other person while using the Gameguys website and you agree not to conduct yourself in a vulgar or offensive manner while using Gameguys services, or to use the Gameguys website for any unlawful purpose.
Private Use
Games supplied by Gameguys under its rental program may not be used for any commercial purpose or public showing where the copyright owner or licensee so stipulates.
Limitations on Use
You must be 18 years of age or older to use the Gameguys service. Unless otherwise specified, the content on the Gameguys website is for your personal and non-commercial use and Gameguys grants you a limited licence to access the Gameguys website for that purpose. You may not download (other than through page caching necessary for personal use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the Gameguys website without Gameguys prior written consent. Any unauthorized use of the Gameguys website or its contents or goods or services provided by Gameguys will terminate the limited licence granted by Gameguys.
Free Trial
Gameguys sometimes offers free trials to first time subscribers to the Gameguys service. Where a free trial is on the home page at the time you subscribe (which will be when Gameguys confirms you are admitted as a subscriber) you will not be charged for the period of the free trial but otherwise the Terms of Use apply. Only one free trial may be redeemed per household. You will be billed the normal monthly subscription payment at the end of the trial period unless you have cancelled your account in the account section when you are logged in or are on the Direct Debit payment method (see below for Direct Debit payment method terms). Normal cancellation terms apply as specified in the Terms of Use. The free trial period will commence immediately on completing the join process unless you are on the Direct Debit payment method (see below for Direct Debit payment method terms). Gameguys reserves the right to cancel any free trial at any time and vary the terms and conditions applicable to a free trial and any such cancellation or variation shall have immediate affect upon removal of a free trial from the website or upon any variation being posted on the website.
Gameguys Gift Vouchers
Gift Vouchers are non-refundable and are not redeemable for cash. The Free Trial does not apply when a Gift Voucher is redeemed. The Gift Voucher's stated period and membership plan cannot be altered. Recipients will need a valid Credit Card or Direct Debit to activate their membership. During the Gift Voucher's stated period, the recipient will not be charged membership fees as long as the membership plan specified on the Gift Voucher is not changed. Billing will commence on completion of the Gift Voucher's stated period unless you are on the Direct Debit payment method (see below for Direct Debit payment method terms) or if the recipient changes to another membership plan, provided the account has not been cancelled. Only one Gift Voucher can be redeemed per monthly billing cycle. Gameguys is not responsible for lost or stolen Gift Vouchers. Gift Vouchers and their use are subject to Gameguys Terms of Use. Gameguys reserves the right to change its Gift Voucher Terms of Use from time to time in its sole discretion.
Gameguys Direct Marketing Promotions
Gameguys (in association with various direct marketing companies) sometimes offers promotional plans to new or existing members. Such promotion plans are paid for at the time of sale, however any time credit the promotion grants is not effective until the promotion code is used (by creating a new account and using the promotion code purchased).
Refer A Friend
From time to time Gameguys will run promotions allowing current members to introduce their friends and family (not already using Gameguys) to the service. Any gift or offer for the new member is only applicable where the new member is not a current or past member of Gameguys. Only one gift or offer for the new subscriber may be redeemed per household. Gameguys reserves the right to vary any of these terms at any time by posting new terms on its Terms of Use. Any discontinuance of the Refer A Friend programme or any variation of the terms of the Refer A Friend programme shall have immediate effect upon removal of the Refer A Friend programme from the website or the posting of the varied terms on the website.
Direct Debit payment method
Gameguys offers Direct Debit as an alternative payment method to Credit Card. It is a condition of use of the Direct Debit payment method that all free or pre-paid time (ie. a promotion, free trial or gift voucher) will be credited to your account only after your first successful membership payment on the membership plan specified by the promotion, free trial or gift voucher. The purpose of this is to ensure Gameguys has a valid payment method as a security measure before Games are dispatched.
Notices
Any notice from Gameguys will be deemed served when it has been dispatched from Gameguys computer to the email address last specified by you irrespective of whether such email can be delivered or is received.
